Terms and Conditions for  Tata Tea Chakra Gold - Pudhu Aaramabam Campaign

 

1. Introduction

These Terms and Conditions ("T&Cs") govern the participation in the Tata Tea Chakra Gold - Pudhu Aaramabam Campaign ("Campaign") organized by Tata Consumer Products Limited ("TCPL"). By participating in this Campaign, participants agree to comply with and be bound by these T&Cs.

 

2. Campaign Overview

Participants can engage with the Campaign through a web-based AR experience by scanning a QR code or visiting www.tatateachakragold.com

 

3. Campaign Period

14thApril 2025 upto 15th April 2025

 

4. Eligibility

a. The Campaign is open to all Indian citizens aged 18 years and above.

b. Participants must have access to a smartphone or device with internet connectivity.

6. Data Collection and Use

a. By participating in the Campaign, participants consent to TCPL collecting personal information such as language, location, and uploaded images.

b. The data collected will be used solely for the purpose of this Campaign and in accordance with TCPL's Privacy Policy.

 

 

7. Publicity:

The Participant/s undertake and irrevocably and unconditionally permit TCPL to cover the Campaign including their submitted or shared responses, videos, images through various media including but not limited to newspapers, radio, television, news channels, internet, point of sale materials, social media etc., without any consideration and shall not raise any objection, protest or demur to such coverage or in this regard.

 

8. Intellectual Property:

a.     All right, title and interest, including but not limited to the intellectual property rights, in the promotional material(s) and in any and all responses received shall vest solely and exclusively with TCPL at all times. TCPL or any person or entity permitted by TCPL in this regard shall be entitled to use the responses received or any information in connection with the entry in any media for future promotional, marketing, publicity and any other purpose, without any permission and or payment to the Participant.

b.     All material submitted in connection with the Campaign (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to TCPL upon submission and become the property of TCPL exclusively. TCPL may use the material in any medium in any reasonable manner it sees fit. Copyright in any such material remains the sole property of TCPL.

9.  Dispute:

a.     The courts of competent jurisdiction at Bengaluru, Karntaka shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with, the Campaign. Participation in the Campaign is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including (without limitation) this clause.

b.     Further all issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the Participants and/or TCPL and/or Partners of this Campaign, shall be governed and construed in accordance with the laws of the Republic of India.

10. Miscellaneous

a. TCPL shall not be liable to perform any of its respective obligations under the Campaign where it is unable to do so as a result of circumstances beyond its control in the nature of pandemics, natural calamities, state emergency, riots, government restrictions, internet failure or any other force majeure conditions, etc.

b. Failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies on the part of TCPL.

c. TCPL accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, loss of internet connectivity, unique codes, documents or correspondence whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. TCPL shall not be liable for any consequences of user error including (without limitation) costs incurred.

d. Errors outside the control of TCPL and technology providers pertaining to the AI tool might occur and TCPL shall not be held liable for the same.

e. TCPL shall not be liable to any person or entity for any direct, indirect, incidental, special, punitive or consequential damages, including loss of profits, incurred by the participant, in connection with this Campaign.

f. If a participant is dissatisfied with the Campaign or these T&C’s and/or any content or any requirements of the Campaign or the materials available related thereto, their sole and exclusive remedy is to not participate in this Campaign.
